Affidavit of Capacity to Marry:

The petitioner has to get this at the Manila US embassy if he wishes to marry in the Philippines. Requirements are on the Manila US embassy website.

We both went together at the US embassy, Manila but you will not be able to go with the petitioner inside the room where he will be having his face to face interview with the consul officer. Craig presented his divorce papers (since he is divorced) after which he filled up the form and paid the fee.

The first thing we did before applying for a marriage license is to get the Affidavit in Lieu of Cetificate of Legal Capacity to Contract Marriage for American Citizens. This is more popularly known to many applying couple as "Affidavit of Legal Capacity To Marry." Being a US citizen, Craig has to comply with the procedure be we can proceed with our Philippine wedding.

This is a copy of our marriage certificate that we actually signed right after our wedding ceremony. This is the non-authenticated one which has to be filed at National Statistics Office (NSO) in the city where the bride's town is closest.

Note: You have to file one like this to get an authenticated copy from the NSO office.

Note: Do NOT submit the original unless you are told to do so. There's a tendency where your original copy would get lost and the USCIS doesn't return them. You can still get copies from the NSO but it will be a long wait, and time consuming.
