The Non-Immigrant Spousal Visa Petition (K3) Form I-129F
I-129F Non-Immigrant Petition for Spouse of US Citizen
The documents we submitted were almost the same as that of the I-130 package, with the inclusion of a copy of the I-797 (Notice of Action-2) or Notice of Petition Approval from the I-130 petition. To summarize with, and to make it more understandable, here are the exact documents as itemized below:
- Form G-28 (Notice of Entry of Appearance as Attorney or Representative (1 page), filled up and signed by petitioner and lawyer.
- Form I-129F (3 pages) - filled up and signed by my husband.
- Form G-325A-4 pages (2 sets) - each set filled up and signed by my husband and me.
- 2 passport size photos each for my husband and me.
- Copy of I-130 NOA-2
- Copy of our marriage certificate.
- A copy of the Affidavit in Lieu of Certificate of Legal Capacity To Contract Marriage for American Citizens, signed by the petitioner and US vice consul.
- A copy of our marriage license.
- Cover Letter
- Copies of my husband's divorce decrees.
- Copies of my husband's birth certificates (he has 2 kinds)
- Copy of my birth certificate.
- Copies of my husband's passport pages (exit/entry stamps)
- Copies of my husband's boarding passes and airline tickets going to and from the Philippines
- Evidences of Genuine Relationship (we submitted lots of emails and chat logs!)
- Snail mails that I sent to my husband.
- A check for the filing fee.
I-797C Notice of Action - 1 & 2:
NOA-1
Craig (petitioner) and our lawyer received both the notice (NOA- 1 & 2). We are instead sharing our lawyer's copy :).

NOA - 2
This means that our petition is approved which means the papers can go ahead further for processing.
